The following terminology applies to these Terms and Conditions, Privacy Statement  and any or all Agreements: “Website”, “site” and “the site” refers to ezscan-au.com “Client”, “You” and “Your” refers to You, the person accessing this website and accepting the Company’s terms and conditions. “LookThru”, “The Company”, “Ourselves”, “Our”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

1) Hosting/Duration:

All 3D tours supplied by LookThru are uploaded onto the ‘Matterport cloud’ and a zero-cost hosting period of three months is granted to all new 3D Tours when uploaded. The three-month hosting period will commence on the date on which the 3D tour is uploaded and accessible to the public. Monthly extensions are available for the price of AU $14.99 once the three-month threshold period has expired. If the client does not wish to extend the hosting period of the 3D tour, the 3D tour will be removed from any hosting websites, including all media platforms, and will thus become inaccessible to view.  

2) Archiving: 

The option to archive a 3D tour indefinitely is available at a price of AU $50.00. This enables the client to regain access to their 3D tour if a re-upload is requested at a future date. If the client does not specify the request of their 3D tour being archived once the hosting period expires and no extension period is requested, the client automatically forfeits their rights for any further use of the 3D Tour.  

 

3) Appointment conditions: 

LookThru does not bear any responsibility of conditioning of the property. On the day of the scheduled appointment, the property will be photographed in the condition that the property is set  by the owner or real estate agent. LookThru is not responsible for cleaning or organising the property prior to scans. The property must be organised the way in which it is intended to be photographed prior to appointment.  

 4) Delay period:  

 At the time of the appointment, if the owner or real estate agent is not present at the confirmed scheduled time, LookThru allows for a 40 minute delay period in which contact will be attempted. If no contact is made and the service can not be completed, a $70.00 cancellation fee may be charged. LookThru has the authority to not issue a cancellation fee depending on circumstances that LookThru deems appropriate. If an additional appointment is made for a future date, the cancellation fee will be transferred and charged onto the invoice of the future appointment. If the client does not want to make a further appointment, the $70.00 cancellation fee must be paid in full within 30 days after the initial date of the appointment.  

 

5) Cancellation Policy:

 Scheduled appointments can be cancelled 48 hours before the appointment date with no cancellation fee applied. If a client cancels an appointment within the 48 hours of an appointment, LookThru reserves the rights to charge a $70.00 cancellation fee.  

If LookThru Employees cannot make a scheduled appointment, they will make contact with the client to rather reschedule or cancel the appointment based on the client’s needs. No discounts or free services will be granted by any means if LookThru cannot deliver the arranged appointment. If payment has already been processed and the client wishes not to continue with a rescheduled appointment, LookThru will reimburse the complete payment made by the client.  

6) Condition of Property:  

The circumstances to which LookThru deems unfit for our services are reserved by LookThru standards. The Property must be cleaned in accordance to LookThru standards prior to the scheduled LookThru appointment. These standards are that all properties must be organized without any clutter or loose belongings on the floors, or in a position that seems untidy. Furniture must be placed in their correct location, this location is based on the accessibility of the property, any furniture that blocks access to a room or prevents the ability of our services will be deemed as unfit for our services and the service may be discontinued and your appointment may be voided, and a cancellation fee may be issued to the client. The kitchen must be cleaned prior to the scheduled LookThru appointment, no stains on any surfaces should be visible. Dirty or drying dishes should not be visible as well, and the sink should be appropriately cleaned and dry. Bathrooms should be tidied, with no wet surfaces visible, nor dirty towels within the vicinity. Bedrooms should have all personal belongings stored away, cupboards and storage spaces must be closed and not perceived to be cluttered and unable to be closed. Beds must be made, and clothing should not be visible anywhere within the room unless the room contains a storage space that cannot be closed and/or is impossible to veil. 

LookThru takes no responsibility, nor can LookThru be held accountable for any belongings found to be missing, relocated or broken. LookThru Employees work in a manner of respect and decency, we will not touch any belonging within the properties that our services have been ordered within unless given permission by the tenant or property owner at the time of the appointment or specified prior to appointment.  

 All pets if present should be secured away from the area in which LookThru’s services are to be established. If LookThru is not provided with information of any animal(s) being present within a property, LookThru holds no responsibility towards any animal(s) safety or actions.  

 

7) Invoicing & Payment:   

Payment for the service must be made in full within 30 days after the invoice issuance. The invoice will be issued digitally via email once the service has been provided and uploaded. Once payment has been received, a receipt indicating proof of payment will be issued.  

You will provide LookThru with valid and updated credit card information, or with a valid purchase order or alternative document reasonably acceptable to LookThru. If you provide credit card information to LookThru, You authorize LookThru to charge such credit card for all Purchased Services listed in the Order Form.  Such charges shall be made in advance, either annually or in accordance with any different billing frequency stated in the applicable Order Form. If the Order form specifies that payment will be by a method other than a credit card, LookThru will invoice you in advance and otherwise in accordance with the relevant Order Form. Unless otherwise stated in the Order Form, invoiced charges are due net 30 days from the invoice date. You are responsible for providing complete and accurate billing and contact information to LookThru and notifying LookThru of any changes to such information.  

 

8) Trail Agreement 

LookThru may provide a complimentary ‘Service Trail’ in regards to LookThrus Premium Service package. This enables companies who are interested to test before they buy and to see first hand what our services provide. This Service Trail is only available for Proprietors of real estate companies and/or companies of same business equivalence. LookThru reserves the rights to refuse a Service Trail by any means of a request. When providing a Service Trail, LookThru will reduce all costs excluding the labour costs of the service. The labour cost is A$99 and will be charged on commencement of the service request. 

Within the Service Trail, LookThru will provide all features that are included within the Premium package. The produced materials will function like any service LookThru provides and will uphold the same level of time restrictions on 

 9) Disclaimer of Warranties, Liabilities, and Limitations 

 If for any reason, we believe that you have not complied with these terms and conditions, we may, at our sole discretion, cancel your access to the registered LookThru Scan services which includes a 3D tour(s), Photography, Floor plan(s), Website(s) and other services provided by LookThru immediately and without prior notice.  

We may terminate your registered account and related services, at our sole discretion, by emailing you at the address you have registered stating that the agreement has terminated.  

LookThru reserves the right to withhold materials and services if deemed necessary.  

 LookThru does not guarantee, represent, or warrant that your use of LookThru’s Services will be uninterrupted or Error-Free, and you agree that after the 3 month threshold period, if no further instructions are provided by you, that LookThru may remove the LookThru Services for indefinite periods of time, or cancel the LookThru services at any time without notice to you. 

You expressly agree that your use of, or inability to use, the LookThru Services is at your sole risk. The LookThru Services and all products and services delivered to you through the LookThru Services are (except as expressly stated by LookThru) provided “As is” and “As available” for your use, without warranties of any kind, either expressed or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and noninfringements. Because some jurisdictions do not allow the exclusion of implied warranties, the above exclusion of implied warranties may not apply to you. 

 LookThru reserves the rights of all data and produced material once the threshold period has expired within a LookThru service. Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure. When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years, and used for business purposes that LookThru deems fit – If a client wishes for all data and produced material to be removed and destroyed permanently, an email from the client must be sent requesting their data and produced materials to be removed and permanently destroyed. If no such email is presented, LookThru takes full responsibility and ownership of all date and produced materials. 

  10) Intellectual Property Clause 

The services and their original content, features and functionality are owned by LookThru and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 

  These Terms and conditions are governed by the laws of Australia, By signing or clicking ‘yes’ in this contract, you, the client, acknowledge, and agree to the distribution of private material, along with all terms and conditions specified in the ‘Terms & Conditions’.
